That Tuesday morning, just after 12:15 a.m., Timberlake was pulled over near Madison Street and Middle Line Highway while operating a gray BMW registered in Florida. The criminal complaint states that Timberlake’s initial offenses were running a stop sign and failing to stay on the right side of the road.
However, after speaking with Timberlake, authorities claimed it was evident that he was unfit to drive, as per Sag Harbor Village police officer Michael Arkinson’s report.
The defendant was “found to be operating said vehicle in an intoxicated condition due to his bloodshot and glassy eyes, strong breath odor, inability to divide attention, slowed speech, unsteadiness while walking, and poor performance on all standardized field sobriety tests,” according to Arkinson’s report.
According to the story, Timberlake found it difficult to stand on one foot without swaying or relying on his arms for balance. Timberlake was cited by the officer as saying, “I followed my friends home after having one martini.” Authorities claimed he replied them, “No, I’m not doing a chemical test,” when they asked him to submit to a test for impairment.

The next conference is scheduled for August 9, and Timberlake is not required to attend. Another hearing is scheduled for September 13, but Burke Jr. said that it may not happen depending on what happens in August. Timberlake had dinner at the American Hotel in Sag Harbor “and then headed to a friend’s house when he was pulled over by police,” according to a source close to him.
